1. Application of Terms/Eligibility

1.1 These terms and conditions (“Terms”) are applicable to and govern your participation in the Trade In program (“Trade In”) to upgrade your tobacco heating system [IQOS 2.4 or IQOS 2.4+ or IQOS 3 or IQOS 3 MULTI or IQOS 3 DUO or Lil SOLID] (“Device”) to the new IQOS ILUMA device (“IQOS ILLUMA”). You should read these Terms carefully as they affect your legal rights and govern your relationship with «Papastratos Cigarette Manufacturing Company» with the distinctive title Papastratos CMC S.A., based in Aspropyrgos, Imeros Topos, Location Kororemi, P.C 193 00 Greece, with Company Registry Number: 227601000 (General Electronic Commercial Registry-Geniko Emboriko Mitroo-G.Ε.ΜH.), VAT 094011481 Tax office: FAE ATHINON (“[“Papastratos” or “We”]”).

1.2 You are only eligible to this Trade-in if: (i) we have verified you are a Device user aged over 18 years old; (ii) you are registered in Papastratos Adult Consumer Database; (iii) your Device, which you wish to Trade-in, is registered on your personal account (iv) your main residence is in Greece and (v) your Device is not disarticulated and comprises of the pocket charger and holder (which are each in one part), except for IQOS 3 MULTI and Lil SOLID (which are one part anyway). Papastratos reserves the right to set also other additional minimum requirements regarding who have the right to participate in the present program and/or which Devices, that will be publicly announced from time to time like for instance in the iqos.gr website, and/or the IQOS Club Platform and/or other public physical or digital means, at Papastratos discretion (hereinafter “publicly announced”)

1.3 You are not required to possess the charging cable, original box, or other accessories complimentary to the Device to participate in Trade-in.

1.4 You may register yourself and your Device in our Adults Consumer Database at iqos.gr, or by calling customer service center [by phone at 8001114767 (toll-free from a landline) or by phone at 2104193888 from a mobile phone], or by meeting an IQOS representative or at IQOS stores which you can find in the following link mentioned as IQOS Stores

1.5 By participating in Trade-in, you agree to be bound by these Terms. If you do not agree or cannot comply with these Terms, then you are not permitted to participate in the Trade-in Program. No modification of these Terms by you is permitted unless Papastratos expressly agrees in writing.

1.6 We also reserve the right to amend these Terms upon notice that will be publicly announced, at any time.


2. Trade in conditions

2.1 The Trade-in program is not available in all channels/stores. To get information about channels, where the Trade-in is available, contact our customer service center or visit iqos.gr

2.2 The Trade-in allows you to receive a discount on your purchase of the device of IQOS ILUMA in exchange for you renouncing ownership and returning in your current IQOS / lil Device to the Seller of the IQOS ILUMA device and is subject to the conditions laid down in article 2.9. below. As Sellers are defined either the physical point seller who participates in the Trade-in Program or the distance sales seller who either acts as an indirect agent for the sale of products via iqos.gr, under the iqos.gr purchase terms and conditions, or as a reseller via its own website under its own (the reseller’s) purchase terms and conditions.

2.3 a) The amount of discount received shall depend on your old Device’s warranty status and/or on other criteria that would be publicly announced from time to time by Papastratos. Should you be an IQOS CLUB member an additional discount may be awarded from time to time, depending on your loyalty status as well as loyalty points (depending on your loyalty status/level). It is noted that the current Trade-in discount depends on the warranty status of the device to be returned. The discount applies on the price of the IQOS ILUMA device at the time of the sale of the device at the sale point. More specifically the following are applicable at present:

b) Papastratos reserves the right to alter the applicable discounts from time to time, at its discretion, further to a relevant Public Announcement. In any case, you shall be informed on the price of the Device and on the applicable discount at the point of sale (physical or distant) before the conclusion of the purchase of the IQOS ILUMA.

2.4 The Devices with the following circumstances are not acceptable for the Trade-in program:

    (i) Devices with a serial number (codentify code) that has been altered, defaced or removed or is not readable by any cause;

    (ii) Devices that have been opened, serviced, modified or altered in a manner not authorized by Papastratos;

    (iii) Devices that do not fall under 1.1. above

2.5 The discount determined pursuant to section 2.3.a) shall be valid for the period of your visit in the IQOS Store, your call with customer service center, digital interaction on our website or on any third-party website that sells our products or interaction through other channels, where the program is applicable, as the case may be, for a purchase of an IQOS ILUMA. In case you refrain from purchasing the IQOS ILUMA during that visit in the IQOS Store or other channels, where the Trade-in is available and wish to participate in Trade-in at a later stage, the discount for your Device shall be determined during your subsequent visit in the IQOS Store or other channels, where the Trade-in is available, according to what is applicable at that time under the reservation as referred in article 2.3.b) above.

2.6 A maximum of one discount determined pursuant to section 2.3 may be used for the purchase of one IQOS ILUMA.

2.7 You may Trade-in up to a maximum of 3 times per calendar year for the purchase of 3 different IQOS ILUMA.

2.8 Returning a Device of a certain colour (especially limited-edition colours), pursuant to section 2.2 of these Terms, does not guarantee the availability to use the applicable discount for the purchase of an IQOS ILUMA of the same colour.

2.9 When the Trade-in transaction is completed, your old Device will be sent for recycling thus Papastratos and the Seller will not be able to return the traded in device should you want to return to your previous device. In addition, since the purchase of the IQOS ILUMA is a new purchase contract for that device in specific, in case that you purchase it via a Distance Sales Channel and you wish to exercise your right of withdrawal you will receive back the discounted amount paid for the IQOS ILUMA, without getting also back the Device you have traded in. The same applies for the ‘Money Back’ program from purchases made in any channel where that program applies too (you shall receive back the money paid but not the initial Device). The present term constitutes a fundamental term for the execution of the present agreement.

2.10 Participation in the Trade-in program is subject to availability of the IQOS ILUMA stock.

2.11 In case of participating in the Trade-in program through Distance Sales Channels where the Trade-in program applies, and receiving your IQOS ILUMA by delivery, you are obliged to return the Device to the Seller unpacked either at the time that the IQOS ILUMA is delivered to you, or the latest within 15 days from receipt upon communication from our call center as laid down in 2.14 below.

2.12 We may refuse your application to participate, or we may terminate your right to participate in the Trade-in including if you breach any of these Terms and/or act in an illegal manner (like indicatively but not exhaustively in case no return or return of a non-eligible older generation device).

2.13 When you receive the ILUMA device via courier, you are requested to give the courier the agreed old device unpacked, that will be received with the reservation of being checked by the Seller and/or Papastratos.

2.14 In case that it is determined that you did not return the agreed old Device as laid down in 2.13 we will contact you via an email or a call or an SMS or viber in order to arrange for a second attempt to receive back the correct old device and to return to you the wrong one via courier. If you are not compliant with the process or fail to return to us an eligible old Device, notwithstanding any other rights of Papastratos, you will be excluded from further Trade-in orders. Likewise, to be eligible to participate again in Trade-in, all previous Trade-in orders should be completed effectively (returned device is confirmed and it is the one agreed to be returned), meaning you are not able to start 2 Trade-in orders simultaneously, nor you can start a Trade-in while another is in progress or on the way. In any case the provision of the clause 2.9 apply regarding the destruction of the devices received back.

2.15 By proceeding to a Trade-in order you are purchasing an IQOS ILUMA device only. The present program does not apply to the purchase of an IQOS ILUMA Ready to Go kit.


3. Miscellaneous

3.1 Papastratos and/or the Sellers shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your participation in the Trade In.

3.2 Use of personal data: When you participate in the Trade In program, Papastratos Philip Morris will use data about you as described in its privacy notice, available here. We implement appropriate technical and organizational measures to protect personal information that we hold from unauthorized disclosure, use, alteration or destruction. Where appropriate, we use encryption and other technologies that can assist in securing the information you provide. We also require our service providers to comply with strict data privacy and security requirements In case of purchase via iqos.gr or Papastratos call center, the privacy notice for the distance sales purchases applies too, as available here. In all other cases of sale (via physical channels or via third party websites), the Sellers shall process your personal data in the context of executing the terms of the program, according to their own privacy policy under their own responsibility.

3.3 The present terms do not alter in any way whatsoever the applicable purchase terms from any sale channels, including but not limited to the distance sales terms and conditions of iqos.gr, that continue to apply cumulatively with the present terms for the purchase of the IQOS ILLUMA under the present program when a purchase is conducted via the iqos.gr eshop. Also, the present program does not substitute the applicable legal or commercial guarantees of the Devices and/or the IQOS ILLUMA provided by Papastratos from time to time that continue to apply as provisioned in their relevant terms.

3.4 These Terms are subject to the laws of Greece. Any legal dispute will be subject to the exclusive jurisdiction of the Courts of Athens.
